These terms cover HyperGeek Cell Explorer, Cell Shell, and the rest of this site and app, published by Hyper Intelligence, LLC ("we"). By using them, you agree to these terms. If you're a child, please read them with a parent, guardian, or teacher.
You may use the app for personal, home, and classroom learning, and teachers may show it to their classes and share its links. Please don't resell it, copy large parts of its content into other products, or present it as your own.
The app is made for learners of all ages, including children. Children use it without an account, and we don't collect personal information from them (see the Privacy Policy). We encourage parents and teachers to explore it together with young learners.
The HyperGeek and Cell Shell names, and the app's original text, illustrations, characters, and software, are owned by Hyper Intelligence, LLC. Some material belongs to others and is used with credit: short quotations from published works, public-domain map data (Natural Earth), and open-licensed fonts (SIL Open Font License). Links to outside websites are provided for learning; we don't control those sites.
Scientists, scholars, mentors, and historical figures appear so learners can learn from their work; their inclusion doesn't mean they endorse the app. Myths, faiths, and cultural traditions are described for learning, with respect, and many of them are living traditions practiced today. Story characters such as the Guardians, the Wardens, and the animal guides are original fiction. Mentions of other works, such as the album that inspired EpHunk's name, don't imply any affiliation.
Please don't try to break, overload, or get around the app's protections, access someone else's account, or use the app to harm anyone.
Accounts are for adults 18 or older who are parents, guardians, teachers, or school staff. Children use the app without an account. Keep access to your email secure, since sign-in links are sent there. You can delete your account at any time from the Account page.
Paid plans are offered on the website only, and are billed by invoice through Relay; nothing is charged on this site or in the app. A plan starts when its invoice is paid and runs through the paid-through date shown on your Account page. The price, billing period, and payment terms are the ones on your invoice. You can cancel from your Account page at any time; a canceled plan won't be invoiced again. Every learning topic and level stays free on every plan.
These terms are between you and Hyper Intelligence, LLC, not Apple. Apple has no responsibility to provide maintenance or support for the app. If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claims about the app, including product claims, legal or regulatory compliance, consumer protection, and claims that the app infringes someone else's intellectual property. You confirm you're not located in a country subject to a U.S. government embargo and aren't on a U.S. government list of prohibited or restricted parties. You agree to follow any third-party terms that apply when you use the app, such as your wireless carrier's. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If you send us ideas or suggestions, we may use them to improve the app, without any obligation to you.
The app is provided "as is," without warranty of any kind. Content is simplified for teaching and should not be relied on for medical, clinical, diagnostic, or professional research decisions.
To the fullest extent the law allows, Hyper Intelligence, LLC won't be liable for any indirect, incidental, or consequential damages arising from your use of the app, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $50 if you paid nothing.
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in California, except where the law where you live gives you the right to bring a claim elsewhere.
We may update these terms as the app grows. We'll change the date at the top when we do, and if a change is significant, we'll tell account holders by email.
